1. Overview
Modern Software Solutions Pty Ltd (ABN 26 693 567 734) ("we", "us", "our") is committed to protecting the privacy of personal information we collect, hold, and use. This policy outlines how we handle personal information in accordance with the Australian Privacy Act 1988 (Cth) and the thirteen Australian Privacy Principles (APPs). This policy satisfies our obligations under APP 1 to manage personal information in an open and transparent way.
2. Information We Collect
We may collect personal information including your name, company name, email address, phone number, and any other information you provide when contacting us through our website or in the course of providing our services. We collect this information directly from you and only when reasonably necessary for our business functions (APP 3). We do not collect sensitive information unless required by law or with your explicit consent.
If we receive personal information that we did not solicit, we will assess whether we could have collected it under APP 3. If not, we will destroy or de-identify the information as soon as practicable (APP 4).
3. Notification of Collection
At or before the time we collect your personal information, or as soon as practicable afterwards, we will notify you of: who we are and how to contact us, the purposes of collection, the types of organisations we may disclose your information to, and how you may access or correct your information (APP 5). If you choose not to provide the personal information we request, we may be unable to respond to your enquiry or provide our services to you.
4. Anonymity and Pseudonymity
Where it is lawful and practicable, you have the option of not identifying yourself or of using a pseudonym when dealing with us (APP 2). However, if you choose not to provide your identity, we may be unable to provide certain services or respond to your enquiry.
5. How We Use Your Information
We use the personal information we collect for the primary purpose for which it was collected: to respond to your enquiries, provide our services, communicate with you about projects and engagements, comply with legal obligations, and improve our services (APP 6). We will not use or disclose your personal information for a secondary purpose unless you would reasonably expect us to, you have consented, or we are required or authorised by law to do so. We do not use your personal information for direct marketing without your consent (APP 7).
6. Disclosure of Information
We do not sell, trade, or rent your personal information to third parties. We may disclose your information to our service providers who assist us in operating our business (such as hosting providers or email services), but only where those providers are bound by appropriate confidentiality and privacy obligations. We may also disclose information where required or authorised by Australian law or a court order.
7. Cross-Border Disclosure
Some of our service providers (such as cloud hosting or email infrastructure) may store or process data outside of Australia. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient complies with the APPs, or we obtain your consent, or we are satisfied that the recipient is subject to a substantially similar privacy regime (APP 8). We remain accountable for the handling of your personal information by overseas recipients.
8. Data Quality
We take reasonable steps to ensure the personal information we collect, use, and disclose is accurate, up-to-date, complete, and relevant (APP 10).
9. Data Security
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure (APP 11). Our security practices are aligned to recognised industry standards. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
When we no longer need personal information for any purpose for which it may be used or disclosed under the APPs, and we are not required by law to retain it, we will take reasonable steps to destroy or de-identify the information (APP 11.2).
10. Notifiable Data Breaches
In the event of an eligible data breach (as defined under Part IIIC of the Privacy Act 1988), we will notify the Office of the Australian Information Commissioner (OAIC) and affected individuals as soon as practicable, in accordance with the Notifiable Data Breaches scheme.
11. Access and Correction
You have the right to request access to the personal information we hold about you (APP 12). You also have the right to request that we correct any information that is inaccurate, out-of-date, incomplete, irrelevant, or misleading (APP 13). We will respond to access and correction requests within 30 days. We will not charge you for making a request or for correcting your information.
